This module covers the rules governing the competence of courts to hear international civil proceedings. It also covers applicable law, and alternative means of dispute resolution by means or arbitration.

The module will also explore the legal aspects when drafting legal contracts. Knowledge of these legal aspects will be particularly relevant for lawyers advising clients who are involved in international business transactions.

What you will learn

In this module you will:

  • learn international civil court competence rules and alternative dispute resolution through arbitration
  • develop in-depth knowledge and understanding of the role of arbitration in resolving international commercial disputes
  • understand the rules granting jurisdiction to courts in cross-border commercial disputes. This will apply both globally and in Europe
  • explore possibilities for the right to choose whether to litigate or arbitrate
  • examine the law governing international contracts

By the end of this module, you will be able to:

  • have a clear idea of the relevant legal aspects that have to be considered when disputes from a business contract arise
  • understand the legal aspects that must be considered when drafting legal contracts, maintaining efficient and cost-effective transactional planning
  • understand the jurisdiction of courts in international civil cases
